Terms of Service

This is a working draft, not a finalized agreement. It has not been reviewed by counsel and does not yet name the operating legal entity or a governing-law jurisdiction. Do not treat it as binding until that review is complete.

The service

ESA Pro is drafting and review software for licensed Environmental Professionals. It does not perform an environmental site assessment, render professional opinions, or establish All Appropriate Inquiries. Every deliverable requires review and signature by a qualified Environmental Professional as defined at 40 CFR 312.10.

Accounts

You're responsible for the accuracy of information provided when creating an account and for maintaining the security of your credentials. Firm administrators are responsible for the roles they assign within their firm.

Acceptable use

You agree not to use the service to circumvent the human-review requirements described on our Defensibility page, or to represent an ESA Pro-assisted draft as a final, EP-reviewed report before it has actually been reviewed and signed.

Intellectual property

Your firm retains ownership of the project data, records, and report content it uploads or creates. We retain ownership of the ESA Pro software itself.

Disclaimer

The service is provided "as is." We do not warrant that any output is free of error or that it satisfies any specific regulatory requirement without human review -- that review is a required part of using the product, not an optional safeguard.

Termination

Either party may terminate an account as described in your firm's order agreement. On termination, your firm's data is handled per our data retention practices, described on the Privacy Policy.
